RIDERS RENT TERMS OF SERVICE

Effective Date: January 1, 2025
Welcome to Riders Rent. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Riders Rent, LLC ("Riders Rent," "we," "us," or "our"). These Terms govern your use of our website, services, and platform, accessible via www.ridersrent.com (the "Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
Riders Rent® and Rent Ride Return™ are trademarks of Riders Rent, LLC. Unauthorized use is strictly prohibited.

1. Platform Overview
Riders Rent provides a peer-to-peer online marketplace for the rental and sale of equestrian show apparel, accessories, and related items. Users may list, rent, or purchase items via the Platform. Riders Rent is not the owner, manufacturer, or seller of the items listed and does not guarantee the quality, safety, legality, or condition of any item.

2. Eligibility and Account Requirements
You must be at least 18 years old and capable of entering into legally binding agreements to use the Platform. By registering for an account, you agree to:
Provide accurate and current information;
Maintain the confidentiality of your login credentials;
Be responsible for any activity conducted under your account;
Notify Riders Rent immediately of any unauthorized use.
Riders Rent reserves the right to verify the identity of any user at any time and may suspend or restrict account access during such verification or during the investigation of suspected violations of these Terms.

3. User Obligations
 
3.1 General Conduct
Users agree to use the Platform in accordance with all applicable laws and not to:
Violate any third-party rights;
Use the Platform for any unlawful, fraudulent, or harmful purpose;
Attempt to access accounts, data, or systems without authorization.
 
3.2 Renters’ Responsibilities
Maintain items in the condition received.
Return items by the agreed date.
If an item is not returned within 7 days of the due date, it will be deemed stolen.
No garment may be modified in any way (e.g., cutting, hemming, embroidery). Modified garments will be charged at full replacement value.
Renters are liable for any damages, losses, or late returns.
Payment failures or chargebacks are subject to legal and collection action.
 
3.3 Owners’ Responsibilities
Ensure items are clean, wearable, and accurately described.
Ship on time.
Handle disputes fairly and promptly.
 
3.4 Off-Platform Transactions Prohibited
Users may not solicit, negotiate, or complete transactions outside the Platform.
Accounts violating this may be suspended or permanently banned.
Riders Rent may impose penalties and other remedial actions.
 
3.5 Platform Moderation and Listing Rights
Riders Rent reserves the right to edit, refuse, or remove listings that:
Violate these Terms
Appear unsafe, inaccurate, or misleading
 
4. Payment and Fees
 
4.1 Payment Processing
Payments are processed via Stripe, PayPal, and Affirm. By using Riders Rent, you agree to their respective terms. Riders Rent does not store card information.
 
4.2 Service Fees
A non-refundable service fee is applied per transaction.
 
4.3 Late Returns and Non-Returns
Items returned more than 7 days late will be considered stolen, and renters will be charged the full replacement value.

4.4 Definition of Replacement Value
"Replacement value” = current fair market value or original retail value of the item.
 
4.5 Tax Responsibility
Users are responsible for all applicable taxes (e.g., sales tax, income tax). Riders Rent does not provide tax advice.
 
4.6 Right to Withhold Payouts
Riders Rent may pause payouts during disputes, fraud investigations, or violation reviews.
 
5. Cancellations and Refunds
5.1 No Refund for Sizing Issues
Riders Rent does not offer refunds for sizing issues.
Renters are responsible for reviewing provided measurements.
Riders Rent cannot guarantee fit, as listings are managed by individual owners.
 
6. Shipping, Returns, and Item Condition
 
6.1 Late Shipment by Owner
If an Owner fails to ship on time, the transaction may be canceled by the Renter. Repeated violations may result in account suspension.
 
6.2 Non-Return by Renter
Items not returned within 7 days are deemed unreturned and will be charged at full replacement value.
 
6.3 Lost or Damaged Items
Renters are liable for losses beyond normal wear and tear.
Documentation may be required for damage claims.
Fees may include repair or full replacement cost.
 
6.4 Prohibited Items
Listings must not include counterfeit, dangerous, illegal, or unsanitary items.
 
6.5 Counterfeit or Misrepresented Items
Owners are strictly prohibited from listing counterfeit or misleading items.
Violations may lead to a $250 fine per infraction, removal of listings, or permanent ban.
After 3 violations, the account will be permanently removed.
Riders Rent reserves the right to pursue legal action or cooperate with law enforcement.
Renters must report counterfeit items within 48 hours of delivery.
 
7. Insurance and Risk Disclosure
Insurance is available through third-party providers.
Riders Rent offers optional protection via Shippo and XCover:

Riders Rent does not guarantee coverage unless explicitly chosen by the user.
 
8. Limitation of Liability
Riders Rent is not liable for any:
  • Damages from transactions
  • Injuries from products
  • Platform outages or service interruptions
Disclaimer of Warranties:
All products and services are provided "as is” without warranty. Riders Rent disclaims all express or implied warranties, including merchantability and fitness for a particular purpose.
 
9. Indemnification
Users agree to indemnify Riders Rent for any claims arising from:
Your use of the Platform
Items rented, sold, or listed
Violation of laws or these Terms
 
10. Termination
We may suspend or terminate access at any time. Users remain responsible for obligations prior to termination.

11. Dispute Resolution
All disputes will be resolved by binding arbitration in the State of Indiana.
Class action waivers apply.

12. Modifications
We reserve the right to update these Terms at any time. Continued use = acceptance of new Terms.
 
13. Privacy and Data Use
Use of the Platform is also governed by our Privacy Policy.
