Welcome to Riders Rent. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Riders Rent, LLC ("Riders Rent", "we", "us", or "our"). These Terms govern your use of our website, services, and platform, accessible via www.ridersrent.com (the "Platform").

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.

Riders Rent and Rent Ride Return are trademarks of Riders Rent, LLC. Unauthorized use is prohibited.

1. Platform Overview

Riders Rent provides a peer to peer online marketplace for the rental and sale of equestrian show apparel, accessories, and related items. Users may list, rent, or purchase items via the Platform. Riders Rent is not the owner, manufacturer, or seller of items listed by users and does not guarantee the quality, safety, legality, authenticity, or condition of any item.

2. Eligibility and Account Requirements

You must be at least 18 years old and capable of entering into legally binding agreements to use the Platform. By registering for an account, you agree to:

• Provide accurate and current information
• Maintain the confidentiality of your login credentials
• Be responsible for all activity under your account
• Notify Riders Rent immediately of any unauthorized use

Riders Rent may verify identity and may suspend or restrict accounts during verification or investigation of suspected violations.

3. User Obligations

3.1 General Conduct

• Comply with all applicable laws and regulations
• Do not violate any third party rights
• Do not use the Platform for unlawful, fraudulent, or harmful purposes
• Do not attempt unauthorized access to data or systems

3.2 Renters Responsibilities

• Maintain items in the condition received and follow care instructions
• Use items only for their intended purpose
• Return items by the agreed date using the provided method and packaging
• No alterations or modifications allowed. Violations may be charged up to full replacement value
• Renters are liable for damage, loss, or late return beyond normal wear
• Chargebacks or payment failures may be pursued through collection

3.3 Owners Responsibilities

• Ensure items are clean, wearable, authentic, and accurately described with clear measurements and photos
• Ship on time using the Platform label or approved method with tracking
• Respond to disputes promptly and professionally

3.4 Off Platform Transactions

Users may not solicit, negotiate, or complete transactions outside Riders Rent that originate on the Platform. Violations may lead to suspension, bans, and penalties.

3.5 Platform Moderation

Riders Rent may edit or remove listings that violate these Terms or appear unsafe, inaccurate, or misleading.

4. Payment and Fees

4.1 Payment Processing

Payments are processed by third party processors such as Stripe, PayPal, and Affirm. By using the Platform, you agree to their terms and privacy policies. Riders Rent does not store complete payment data.

4.2 Service Fees

A non refundable service fee applies to each transaction and is disclosed at checkout. Service fees are not returned except where required by law.

4.3 Late or Non Returns

If an item is not returned by the agreed date, the renter may be charged late fees and, after seven calendar days, up to the full replacement value as described in Section 4.4. Unreturned items may be reported as stolen.

4.4 Replacement Value

Replacement value is the fair market value or original retail price for a new or comparable item, as reasonably determined by Riders Rent using information such as receipts, listings, brand pricing, and market data.

4.5 Taxes

Users are responsible for any applicable taxes. Riders Rent may collect and remit sales tax where required. Riders Rent does not provide tax advice.

4.6 Payout Holds

Riders Rent may pause payouts during disputes, investigations, chargeback windows, suspected fraud, or policy violations.

5. Cancellations and Refunds

5.1 Twenty Four Hour Satisfaction Policy

Renters may request a full refund within twenty four hours of confirmed delivery if the item is materially different from its description, unclean, damaged on arrival, counterfeit, or does not reasonably match the listed measurements. Requests must be filed through the Platform within this window with supporting photos or documentation. Riders Rent will review evidence and make a final determination.

5.2 No Refunds for Change of Mind or Fit Preference

Refunds are not provided for simple dislike, style preference, or minor size variance where the item substantially matches the measurements and description provided by the owner. Renters are responsible for reviewing measurements and photos before booking.

5.3 Owner Cancellations

If an owner cancels a confirmed rental after payment, Riders Rent will issue the renter a full refund of the rental amount and service fee. Repeated owner cancellations may result in suspension or removal.

5.4 Late Shipment by Owner

If the owner fails to ship on time or provide valid tracking and the item will not arrive by the rental start date, the renter may cancel for a full refund. Riders Rent may withhold or reverse payout to the owner.

5.5 Non Shipment or Lost Delivery

If a shipment is lost in transit, Riders Rent will coordinate with the carrier and, if applicable, the insurance provider. Renters must report non delivery within forty eight hours of the expected delivery date to qualify for a refund.

5.6 Return Confirmation

Refunds or owner payouts are not issued until the rented item is confirmed returned to the owner in substantially the same condition. Failure to return the item or provide valid return tracking voids refund eligibility.

5.7 Abuse and False Claims

Abuse of refund policies, false claims, or intentional damage may result in account suspension, fee reversal, and legal action. Riders Rent may request additional evidence and will make final determinations based on submitted materials and platform data.

6. Shipping, Returns, and Condition

6.1 Shipping Method and Proof

All shipments must include tracking. Owners should ship using Platform labels or approved methods. Renters must retain packaging and documentation until the rental is complete.

6.2 Return Window and Proof

Renters must ship the item back by the agreed return ship date and upload tracking through the Platform. The item is considered returned when the carrier shows acceptance scan. Failure to provide timely tracking may result in late fees or replacement charges.

6.3 Condition on Return

Items must be returned in substantially the same condition as delivered, accounting for normal wear from proper use. Stains, rips, broken zippers, missing embellishments, or alterations are not normal wear. Owners should document condition within forty eight hours of receipt to raise a claim.

6.4 Cleaning and Care

Unless a listing states professional cleaning is included, renters must follow the care instructions provided by the owner. Do not alter, dye, cut, or tailor any item.

6.5 Prohibited Items

Items that are counterfeit, illegal, dangerous, unsanitary, or otherwise prohibited may not be listed. Riders Rent may remove such listings and take enforcement actions.

6.6 Counterfeit or Misrepresented Items

Owners may not list counterfeit or misrepresented items. Violations may result in fines, listing removal, or permanent ban. Renters must report suspected counterfeit items within forty eight hours of delivery with photos and documentation.

7. Insurance and Risk Disclosure

Shipping insurance may be available via carriers or third party providers such as Shippo or XCover. Coverage is not guaranteed unless explicitly selected and paid for during checkout. Claims are subject to the insurer terms and documentation requirements.

8. Limitation of Liability

To the maximum extent permitted by law, Riders Rent is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising from your use of the Platform or any item. The Platform is provided "as is" and "as available" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, title, or non infringement. In any event, our aggregate liability to you will not exceed the greater of the amounts you paid to Riders Rent in the six months preceding the claim or one hundred dollars.

9. Indemnification

You agree to defend, indemnify, and hold harmless Riders Rent and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys fees, arising out of or related to your use of the Platform, your items or rentals, or your violation of these Terms or applicable law.

10. Termination

Riders Rent may suspend or terminate your access at any time with or without notice for any reason, including suspected fraud, violations of these Terms, or to protect users or the Platform. Users remain responsible for obligations incurred prior to termination.

11. Dispute Resolution

Any dispute arising out of these Terms or the Platform will be resolved by binding arbitration administered by a recognized arbitral forum in Fayette County, Indiana, or another Indiana venue reasonably selected by Riders Rent. You and Riders Rent each waive the right to a jury trial and to participate in a class or representative action. Either party may bring an individual action in small claims court in Indiana. You may opt out of arbitration by sending a written notice to Riders Rent within thirty days of first accepting these Terms.

12. Modifications

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

13. Privacy and Data Use

Use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described in that policy.
